Privacy policy

Omlie LLC (“Omlie” or “us” or “we” or “our”) owns and operates the omlie.com website (“Site”). This Privacy Policy (“Policy”) contains details about how Omlie collects and uses information from you when you use the Site or when you provide it to us in communications over social media services owned and operated by third parties such as Facebook and Instagram (collectively with the Site, the “Services”).

This Policy covers only the Services identified above, and does not apply to information which you may send us by other means. Other websites, mobile applications, and other online services, including the social media platforms you use to interact with Omlie, may have their own privacy policies, and you should consult those accordingly.

The Services are intended for users 21 years of age or older. If you are not 21 years of age or older, you are not permitted to access or use the Services.

This Policy is effective as of: April 9, 2021.

Policy Changes —

Omlie reserves the right to make changes to this Policy at any time. Since this Policy may change over time as we modify or expand our Services, we suggest that you check back from time to time in order to understand how we treat your information. Our Policy’s effective date will always be set forth at the beginning and end of the Policy. Any changes will be immediately incorporated into this Policy, and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.

Any change to this Policy is effective immediately. Your continued use of the Services after any changes are made to this Notice constitutes your acceptance of the changes. If any changes are unacceptable to you, you should cease all use of the Services.

If any changes to this Policy materially affect how Omlie treats or handles personally identifiable information that you have already provided to Omlie or that has otherwise been collected by Omlie, we will notify you by email (if Omlie has a valid email address to use) and give you thirty (30) days to opt-in to the changes as they pertain to your information. If you do not opt-in, your information will continue to be used in a manner that is consistent with the version of this Policy under which it was collected, or the information will be deleted.

Collection and Use of Information —

Personally identifiable information (“PII”) is generally defined as information that, by itself or in combination with other information, is reasonably capable of being linked to a specific individual or household. PII can include, but is not limited to, name, physical address, telephone number, email address, username and password, age/birthdate, credit/debit card number, photograph, office address and other business information, biometric data (e.g., fingerprints), state and/or federal identification numbers (e.g., driver’s license number; social security number; passport number), etc.

There are areas of the Services where you may be asked to provide Omlie with PII or other data, or where such PII or other data may be collected from you in an automated manner. For example, PII (and other related information) such as your name, email address, age, gender, internet protocol (IP) address, and/or weight or other physical attributes may be collected from you when you:

  • contact Omlie with questions, comments or other messages;

  • participate in surveys, questionnaires, or contests;

  • sign up to receive Omlie newsletters; and/or

  • otherwise provide any such information to us voluntarily through the Services including, without limitation, through any webinars or social media platforms.

Depending on the nature of the activity, such as if you publicly upload or post content with PII through the social media aspect of the Services, other users of the respective social media service may be able to view your PII.

Omlie may use your PII and other information to:

  • maintain proper business records and other relevant records;

  • respond to your questions, comments or other messages;

  • process and catalog your responses to surveys or questionnaires;

  • enter you in contests and other promotions;

  • send you Omlie newsletters and other updates;

  • contact you if there are issues with content that you uploaded or posted through the Services;

  • provide ongoing technical support related to the Site;

  • communicate with you regarding additional uses of your PII beyond the scope of this list;

  • deliver services through the Site;

  • improve the content and general administration of the Services;

  • perform internal operations related to the Site (e.g., fraud prevention);

  • troubleshoot software issues and operational problems with the Site;

  • conduct data analysis and testing; and/or

  • monitor the usage of the Services.

Cookies and Other Tracking Technologies —

There are also areas on the Site where Omlie may automatically collect certain pieces of PII and other data as you navigate the Site and elsewhere online, such as your IP address and other data about your internet connection, your operating system, browser type, and other services or equipment you use to access the Site, and usage data.

For example, the Site uses cookies. Cookies are files that are transmitted to your computer when you visit the Site. Cookies can allow Omlie to recognize your browser when you subsequently return to the Site. Cookies may also collect your user preferences when you visit the Site. Omlie uses cookies as described in the following table.

The Site is hosted on a website platform provided by Squarespace. For more information about how Squarespace may collect your PII and other data, please review Squarespace’s privacy policy at https://www.squarespace.com/privacy.

The Site uses Google Analytics. This service uses cookies to analyze your use of the Site. The information collected by these cookies about your use of the Site (including your IP address) is transmitted to and stored on a Google server in the United States. Google uses this information to assess your use of the Site, providing reports on data such as how often you visit the Site, what pages you view when you visit the Site, and what other websites you have visited prior to visiting our Site. Google may transfer this information to third parties in order to provide you with advertising content based on your browsing history. View an overview of Google’s data privacy practices for Google Analytics at https://support.google.com/analytics/answer/6004245. For more information on Google’s privacy practices generally, please review Google’s privacy policy at https://policies.google.com/privacy. To opt out of being tracked by Google Analytics, you may be able to download and install the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout. These Google services may also cause you to receive personalized ads based on your browsing behavior. You may be able to opt out of receiving these personalized ads by using the settings at https://adssettings.google.com/

All of the above-referenced IP addresses and other data will be collected in an automated manner and we may maintain it or associate it with certain other PII we collect in other ways or receive from third parties. This helps us improve our Services, deliver better and more personalized services, estimate our audience size and usage patterns, and store information about your preferences.

This automatically collected data may also be managed by our marketing vendors in order to provide you with targeted ads based on what you appear to be interested in as a result of your activity online, both on our Site and elsewhere. You may be able to opt-out of receiving targeted ads from third-party advertisers and ad networks who are members of the Network Advertising Initiative (NAI) by visiting http://optout.networkadvertising.org/. You may opt-out of receiving targeted advertisements from other companies that perform targeted or interest-based advertising services via the Digital Advertising Alliance (DAA) site at http://optout.aboutads.info/. Please note that when using these ad industry opt-out tools, you may need to execute opt-outs for each browser or device that you use, and that other companies’ opt-outs may function differently than our opt-out. There is no guarantee that all targeted and interest-based advertising will be removed by using the above-referenced industry opt-out tools.

By providing to Omlie the PII and other information referenced above, you agree that Omlie may use such PII and other information in accordance with the terms of this Policy.

Sharing of PII and Other Information —

Omlie may share certain demographic and other statistical information, which may include certain portions of your PII and other data, with potential partners. These partners include companies who have products under consideration for reviews and other features on the Services, or online influencers who are interested in collaborating with Omlie, so those entities have a better sense of what Omlie readers are like.

If you interact with any third-party advertisements on the Site, the entities responsible for those advertisements may collect your PII and other data. You should review the respective privacy policies for any third party you interact with online to learn about how they handle your information.

Omlie will disclose your PII or other data if it reasonably believes it is required to do so by law or in cooperation with a government or law enforcement investigation.  Omlie may also share PII or other data in order to avoid imminent physical harm to any person or damage to any Omlie property.

 Omlie may share your PII with a third party if Omlie’s ownership status changes, such as if Omlie is acquired or if Omlie acquires another entity.

Other than what is referenced above, the PII and other data collected from you is not shared with nor sold to any person or entity outside of Omlie.

Any removal of content by Omlie does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information. Omlie will do its best to accommodate your request, but we cannot guarantee we can remove all PII from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that Omlie needs to make the Site function properly for you, you may not be able to use the Site properly moving forward.

Omlie reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your PII.

Omlie does not knowingly collect any information from persons under 21 years of age, nor are the Services directed at or intended for persons under 21 years of age. If a person under 21 years of age uploads/posts information through the Services without authorization, and such information becomes publicly available, please contact us immediately at info@omlie.com. If Omlie learns we have collected or received PII from any person under 21 years of age, Omlie will delete such information immediately. Again, any removal of content by Omlie does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information.

Omlie does not currently recognize or respond to “Do Not Track” or other similar technical requests you may submit through your computer or browser settings. To learn about how to opt-out of certain kinds of targeted advertising, visit the Network Advertising Initiative website and the Digital Advertising Alliance website. Options you select are browser- and device-specific, and there is no guarantee that these industry-provided opt-out tools will prevent all targeted advertising.

Data Security and Retention —

Omlie implements, uses and maintains industry standard technological security measures that are reasonably designed to help secure your non-public PII from loss, unauthorized access or disclosure, both in storage and in transmission.  These security measures include, but are not limited to, the use of SSL certification to prevent unauthorized access to your PII.

While Omlie takes the issue of protecting your PII seriously, you should exercise discretion in what information you disclose and/or transmit through the Site. Omlie cannot guarantee that information sent over the internet is fully secure. The transmitted information may be intercepted by others before it reaches Omlie. If you are concerned about sending information to Omlie over the internet, please send the information by mail or call us to make other arrangements. Omlie is not responsible for the security of information sent over the internet.

Omlie retains collected information for a reasonable amount of time in order to fulfill the stated purpose for why the information was collected. Omlie will also retain collected information connected to business records for periods of time required by law. If Omlie determines that collected information is no longer needed, it will delete such information. Our collection times will be consistent with applicable law.
